Terms of Service

Welcome to Domin8 Studios. By accessing our website, submitting an intake form, or purchasing a branding package, you agree to be bound by these Terms of Service. Please read them carefully.

1. Services & Scope

Domin8 Studios provides branding, design, and digital identity services specifically for medical professionals and healthcare organizations. Our services include logo design, brand strategy, website landing pages, and visual identity systems.

Exclusions:

We do not provide medical advice, legal advice, or IT support for hospital systems. We are a creative agency, not a medical provider.

2. Payments & Refunds

Payment Structure: Full payment for the "Starter Brand Foundation" and other packages is required upon checkout to secure your engagement.

Refund Policy: Due to the custom nature of our creative work and the reservation of our team's time:

  • Before Work Begins: If you request a cancellation within 24 hours of purchase AND before any onboarding call or design work has commenced, a refund minus a 5% processing fee may be issued.
  • After Work Begins: Once the onboarding process has started or the creative brief has been delivered, all payments are non-refundable.

3. Intellectual Property Rights

  • Final Deliverables: Upon full payment, Domin8 Studios assigns to the Client all right, title, and interest in the Final Deliverables (e.g., the final logo files and brand guide).
  • Preliminary Work: Domin8 Studios retains all rights to rejected concepts, sketches, and preliminary designs. These may not be used by the Client.
  • Portfolio Rights: Domin8 Studios retains the right to display the project in our portfolio, website, and marketing materials for the purpose of demonstrating our capabilities.

4. Patient Privacy & Compliance

Domin8 Studios creates public-facing marketing assets. We do not collect, store, or process Protected Health Information (PHI).

The Client agrees NOT to share, upload, or transmit any patient data, medical records, or PHI to Domin8 Studios via email, project management tools, or intake forms. If you inadvertently share such data, you must notify us immediately so we can delete it.

5. Client Responsibilities

To ensure the success of the project, the Client agrees to:

  • Provide timely feedback (within 3 business days) on design drafts.
  • Ensure they have the legal right to use any names, trademarks, or photos provided to us.
  • Review all final assets for accuracy (spelling, credentials) before public release.

6. Limitation of Liability

In no event shall Domin8 Studios be liable for any indirect, special, or consequential damages arising out of the use of our services. Our total liability shall not exceed the total amount paid by the Client for the specific service in question.
